Terms of service

These Terms & Conditions apply to all orders placed with EMERCYN (“Company,” “we,” “us,” or “our”). By placing an order, you (“Customer”) agree to the following:

Custom Orders

All products are made to order based on Customer specifications. Once production begins, orders cannot be canceled or changed. Minor variations in color, size, placement, or print alignment are considered normal industry standards.

Pricing & Payment

Prices are subject to change without notice.
Full payment is required prior to production unless otherwise agreed in writing.
Applicable California sales tax will be charged unless a valid resale certificate is provided.

Artwork & Proof Approval

Customers are solely responsible for verifying artwork accuracy, including spelling, colors, sizing, and placement. Approval of proofs constitutes final authorization to proceed. EMERCYN is not responsible for errors approved by the Customer.

Intellectual Property

Customers warrant that they own or have permission to use all artwork, logos, and trademarks provided. Customers agree to indemnify and hold EMERCYN harmless from any claims arising from customer-supplied materials.

Use of Finished Work for Marketing

Unless otherwise requested in writing prior to production, the Customer grants EMERCYN a perpetual, royalty-free, non-exclusive right to photograph, reproduce, and display finished garments and related mockups for portfolio use, marketing, website content, and social media, without compensation. Customer-provided logos and designs will be used solely in connection with showcasing completed work and not for resale or unrelated commercial use.

Production & Delivery

Production timelines are estimates and not guaranteed. EMERCYN is not responsible for delays caused by shipping carriers, supply chain disruptions, force majeure events, or customer delays. Shipping costs are non-refundable.

Returns, Refunds & Claims

Due to the custom nature of our products:

Returns and refunds are only accepted for defects or Company errors.
Claims must be submitted within 2 days of delivery.
EMERCYN reserves the right to repair, replace, or refund at its discretion.
No refunds will be issued for customer errors (incorrect sizes, colors, or approved artwork).

Order Overruns & Underruns

An industry-standard variance of up to ±10% (5%) may occur on custom orders. Customers agree to accept and pay for the final quantity produced.

Limitation of Liability

To the fullest extent permitted by California law, EMERCYN’s liability shall not exceed the amount paid for the affected order. EMERCYN is not liable for indirect, incidental, or consequential damages.

Governing Law

These Terms & Conditions are governed by the laws of the State of California.

Production Method Terms

Screen Printing

Ink colors are matched as closely as possible but may vary due to fabric type, color and curing processes.
Minor ink inconsistencies or misregistration are acceptable industry standards.(dont like this comment)
Screen setup fees are non-refundable once production begins.
Re orders may experience slight color variation in fabric due to different dye lots and between print runs.

Embroidery

Stitch count estimates are approximate and may vary.
Small text or fine details may be simplified or enlarged for durability and clarity.
Thread color matching may vary depending on fabric and lighting.
Placement may vary slightly due to garment construction.

Direct-to-Garment (DTG) Printing

DTG printing works best on cotton or cotton-blend garments.
Colors may appear less vibrant on dark garments due to pretreatment.
DTG prints may fade over time depending on care and washing.
Artwork resolution directly impacts print quality.

General Production Disclaimer

Minor variations in color, texture, placement, or garment sizing are not considered defects. Manufacturer inconsistencies in garments are outside our control.

Care Instructions

Care instructions are provided as guidance only. EMERCYN is not responsible for damage caused by improper garment care after delivery.
